Uma visão jurídica dos judeus à luz do Fuero Real

Resumo: O objetivo deste artigo é promover uma reflexão acerca da condição jurídica dos judeus na Castela do século XIII a partir do Fuero Real. Obra normativa elaborada na corte afonsina com a meta de pôr fim à pluralidade jurídica que caracterizava o reino castelhano. Pluralidade que ameaçava a política de centralidade desenvolvida por Afonso X com o intuito de fortalecer o poder monárquico e submeter a nobreza. O Fuero Real era um código jurídico completo, que regulamentava uma grande diversidade de ações que iam desde a definição do próprio poder monárquico à regulamentação das práticas cotidianas, como a atuação dos físicos, o roubo, as feiras e outros mais. Chama atenção o fato de que esta obra tenha um dos seus títulos dedicados aos judeus e que não haja nela outra categoria étnica ou religiosa para a qual os juristas da corte afonsina tenham tido o cuidado de formular uma legislação tão específica. Identificar e analisar os fatores que levaram a este tratamento jurídico específico à luz do contexto do reino castelhano, principalmente no que se refere à proposição de penalidades corporais é a questão que norteará a nossa reflexão. Palavras chaves: Judeus – Fuero Real – Monarquia Abstract The aim of this article is to promote a reflection upon the legal condition of the Jews in Castile in the 13th century, based on the Fuero Real. This is a normative piece of writing based on the Afonso’s court aiming to put an end to the legal pluralism developed by Afonso X with the objective to strengthen the monarchical power and submit the nobility. The Fuero Real was a complete law code, which ruled upon a great diversity of actions such as the definition of the monarchy itself to the regulation of daily activities, like the physicists’ practice field, theft, street markets, and some more. It calls attention to the fact that this piece of writing has one of its titles dedicated to the Jews and there is not any other ethnical or religious group for which the jurists of Afonsos’ court had had the care of formulating such a specific legislation. Identifying and analyzing the facts that led this specific legal treatment in the light of the Castilian kingdom, mainly to the proposition to apply physical punishment is the key point that will guide our reflection.
